will there be a flood of Tax refilings that IRS will have to deal with if DOMA is repealed? (Original Post) srican69 Mar 2013 OP

I would be very surprised if this was retroactive n/t el_bryanto Mar 2013 #3
It might be retroactive. backscatter712 Mar 2013 #5
It also depends on the wording el_bryanto Mar 2013 #6
I don't believe it will be retroactive. There is no clear law for it to revert back to. Dollface Mar 2013 #4

When SCOTUS strikes a law because it's unconstitutional, it's as if the law never existed.

So same-sex couples that were getting shafted out of thousands of dollars of tax deductions or benefits because their marriage "wasn't real" would have every right to refile and get that money back.

if it says that all homosexuals who were married previously are now officially married they have a case. If it says people who weren't allowed to be married are now allowed to be married, than they probably have no case.

On a happy note, I'm already seeing tax planning articles for when/if DOMA is repealed.
