During oral arguments in Lawrence, the attorney challenging the Texas law argued that it was "fundamentally illogical" for straight people to be able to have non-procreative sex without being harassed by the state while same-sex couples did not have the right to be "free from a law that says you can't have any sexual intimacy at all." But Scalia pointed out that gays and lesbians could just have sex with people of the opposite sex instead. "It doesn't say you can't haveyou can't have any sexual intimacy. It says you cannot have sexual intimacy with a person of the same sex." Later on in his dissent, Scalia argued that Americans' constitutional right to equal protection under the law wasn't violated by the Texas law for that reason. "Men and women, heterosexuals and homosexuals, are all subject to (Texas') prohibition of deviate sexual intercourse with someone of the same sex." That should sound familiar: It's the same argument defenders of bans on interracial marriage used to make, arguing that the bans were constitutional because they affected whites and blacks equally.
Scalia has been on a tear lately, calling the Voting Rights Act a "racial entitlement" and ripping into the president in a dissent on Arizona's harsh anti-immigration law in the middle of an election season. But when it comes to LGBT rights, he's been off the rails for a long time

What rigid, narrow, morally certain men like Scalia never realize is that hetero sex seems just as icky to gays. Telling them to go against their basic natures in that department is always going to be doomed to failure.

(794 posts)I wouldn't be surprised if Scalia supported lowering the age of consent to 12 to keep Ted Nugent, Rush Limbaugh and the other right wing pedophiles from being punished for their evil. Scalia has revealed his hatred for America on many ocassions- this is another instance of Teabaggers targeting America for liberty destruction and the unravelling of American cohesion.
Why do Teabaggers hate America? Why does Scalia hate America? Why do fox "news" viewers hate America? Why do NRA gun-fetish advocates hate America?
They hate the liberties and social saftey net that allows Americans to speak the truth to right wing power structures and have a voice about labor, drug, immigration and environmental policy. The strong America created by the new deal and other progressive policies is roundly hated by right wing extremists like Scalia, Glenn Beck and LaPierre. This is the reason right wing teabagger legislators and Scalia are working so hard to destroy our dearly held principles of freedom and equality. I just wish these people that hate America so much would move to a country they like, instead of ruining OUR country.

(10,724 posts)One thing that gets me is that so many objections are based on physical procreation and biological construction.
Not long ago I was listening to an interview about a man who may or may not have "been gay" - the question was about emotional attachment and lifelong partnership with a person of the same sex, but the answer was "he couldn't possibly have been gay", as there was no evidence at all of gay sex having occurred...some people just don't get it, in the most boneheaded obvious way.
It makes one wonder whether some people are capable of feeling or perceiving love, and so can't imagine that its of any importance to others.

(2,124 posts)... in the not-so-dumb world, I heard a story on NPR about parents protecting kids from inappropriate TV. And the family they featured comprised of two fathers and their kids. The gay aspect didn't even come up as an issue in the story, not at all whatsoever, just a mention of how the child's "dads" safeguard their family's TV consumption. This was as clear a sign as any that this is being accepted as a normal situation. Couldn't help but raise a fist in my car on the way to work.

Right up there with Justice Taney leading the way on Dredd Scott and Justice Brown on Plessy v. Ferguson, to be judged harshly for eternity.
