Not 11 and not 13. Cruz claims there were exactly 12 Harvard Law professors who wanted to overthrow the US government. So when will Cruz name names?
Ted Cruz RespondsAnd Still Sees Red at Harvard Law
Posted by Jane Mayer
Senator Ted Cruz has responded to The New Yorkers report that he accused Harvard Law School of having had twelve Communists who believed in the overthrow of the U.S. Government on its faculty when he attended in the early nineties. Cruz doesnt deny that he said this; instead, through his spokesman, he says he was right: Harvard Law was full of Communists.
His spokeswoman Catherine Frazier told The Blaze website that the substantive point in Cruzs charge, made in a speech in 2010, was was absolutely correct.
She went on to explain that the Harvard Law School faculty included numerous self-described proponents of critical legal studiesa school of thought explicitly derived from Marxismand they far outnumbered Republicans. As my story noted, the Critical Legal Studies group consisted of left-leaning professors like Duncan Kennedy, who is a social democrat, not a Communist, and has never believed in the overthrow of the U.S. Government.
Among those who have taken issue with Cruzs castigation of the Harvard Law School faculty are his former law professor, Charles Fried, who is a well-known Republican and former Solicitor General to Ronald Reagan. In his 2010 speech, Cruz had said there was only one Republican on the faculty, but his former professor, Fried, told The New Yorker there were at least four, including himself. A spokesman for Harvard Law School, Robb London, also described the school as puzzled by Cruzs allegations.

It was basically a left-ish legal theory that proposed that the law is not neutral, but instead is completely intertwined with politics, and exists only to support the interests of the class that created it; the ruling classes mainly use the law as an instrument of oppression. I was in law school (not Harvard; CLS was everywhere) when it started to become the hot academic theory; what I remember about it was not that it was extreme (we were like, duh, of course the law is used as an instrument of oppression), but that it was expressed in such academic, abstract, recondite and ungodly dull terms that nobody figured this bunch of chalk-dusted professors who probably could hardly button their corduroy blazers or tie their Hush Puppies without help could possibly be serious revolutionaries because nobody could figure out just quite what they were saying. And once you plowed through the verbiage you saw there was never even a suggestion of actual communism or violent overthrow of the government.
I doubt Cruz got through even the first couple of pages of any of these articles; if he had, he'd know these guys weren't Communists. To be fair, though, staying awake through an entire article by Duncan Kennedy or Robero Unger would be quite a challenge.

(37,161 posts)...it was "communism" and anyone who failed to instantly condemn it was a "communist".
Only half-jokingly, I envision him reading the name in one of those papers and instantly jumping away, reaching for a cross to thrust in front of him as if to ward off a vampire. Or maybe a flag pin... Or photo of St. Ron.

I can't imagine they were suggesting overthrow of the government. Cruz is doing the "mind reading people's motives" thing that right wing true believers do.

Rand Paul would never have had their names on a ballot in the first place if there was some way to test for sanity before their names ever made it to the public arena.
This sick joke of a Senator needs the pitchfork and torches treatment... like tomorrow. And on second thought, there's probably someone heavily padding his pockets for this ignorant distraction from getting the nation's work done.

Cruz (2010): There were fewer declared Republicans in the faculty (of Harvard Law School) when we were there than Communists! There was one Republican. But there were twelve who would say they were Marxists who believed in the Communists overthrowing the United States government.
"Hey Ted! You did not invent this strategy. It's a stupid us-vs-them scare tactic that you and your GOP buddies have come to rely on. It worked for Joe McCarthy for a few years but eventually sank any political future he may have had. Open mouth, insert foot, repeat."
