Police: Man drunk, high when fatally shot friend at Super Bowl party

RIVERSIDE, MO (KCTV) -
A man who had been drinking and smoking marijuana told authorities that he accidentally shot and killed a friend during a Super Bowl party, according to court documents.

Authorities found Josh Anderson, who was struggling to breathe, on the ground outside the suspect's Riverside home. Anderson, who was shot in the back of the head, died at an area hospital from his injuries.

Joshua W. Bailey, 34, is charged with first-degree involuntary manslaughter, two counts of unlawful use of a weapon and armed criminal action. Bailey, who pleaded guilty in 2003 for felony possession of a controlled substance, was charged with being a felon in possession of a firearm.

"There has been a lot of politically charged discussion recently regarding gun rights. This case has nothing to do with that debate," Platte County Prosecutor Eric Zahnd said. "Personally, I am a strong supporter of the Second Amendment's right to bear arms. But virtually everyone agrees that only law-abiding citizens should safely and responsibly possess firearms."

It was not the alcohol or the pot that killed his friend, it was the gun. If they had not had a gun around they would both still be alive. This is why not everyone should have a gun, this guy was a responsible gun owner until he made one stupid mistake and now his friend is dead and his life is ruined. It is a tragedy, and we have seen far too many of these tragedies.

His crime was a non-violent drug offense, now obviously it is irresponsible for him to violate the law by owning a gun, but there is no evidence he was a violent person. There was no violent intent, this is the type of thing that happens far too often with guns. If it were not for the previous non-violent offense this guy would have been a "responsible gun owner" with no criminal intent, this is the kind of stupid mistake that happens when people can own guns without even getting proper training.

After purposely loading the gun, purposely pointing it at his friends head, and purposely pulling the trigger, what did he expect was going to happen?

So he has that as a mitigating factor in his defense.

Bailey told authorities that he had up to five shots of tequila and had smoked marijuana during the Super Bowl party that he hosted in the 4800 block of Homestead Road. He said he was showing off the handgun he had obtained for protection when he put a magazine into the gun and hit the slide release.

"This action chambered a round. Bailey did not think there was a round in the chamber. Bailey stood up from the couch in the living room and pulled the trigger," according to court documents. "The gun went off and struck Anderson in the back of the head. Bailey said the gun just went off and it was not intentional. He said he did not aim the gun at Anderson, but it must have been pointed in his direction."


He "pulled the trigger" and it "just went of and it was not intentional" if you pulled the trigger it was pretty dam intentional...I hope this one spends the rest of his life in jail for intentionally breaking the laws.

killed his friend by wrapping his car around a telephone pole would be be discussing banning cars? People use cars as daily tools in life and people also abuse them and kill people on a daily basis.

More children are killed each year in drunk driving accidents then are killed in school shootings...

People do stupid things that sometimes results in death. Stupid people will always find a way remove themselves or others from the gene pool.

Feed good weapons bans won't accomplish anything except change control of the senate and white house.

Yeah? No, I thought so.

The car equivalent of this story is this guy sneaking up from behind with his car and then running it over his head. It seems that a gun is way more suited for this sort of "accident" than a car.

Any arms legislation is feel good in your eyes - I do think the people of Norway, or Germany, or any other country without a firearms-death epidemic like we have do feel pretty good.
