A New Mexico Lawmaker Wants To Criminalize Post-Rape Abortions
A Republican legislator in New Mexico is seeking to force pregnant rape victims to carry the pregnancy to term, claiming the fetus could be used as "evidence" at trial.
Rep. Cathrynn Brown's bill would charge a rape victim who sought an abortion with a third-degree felony for "tampering with evidence," The Huffington Post reported Wednesday.
"Tampering with evidence consists of destroying, changing, hiding, placing or fabricating any physical evidence with intent to prevent the apprehension, prosecution or conviction of any person or to throw suspicion of the commission of a crime upon another," House Bill 206 reads.
"Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime," it adds.

If getting an abortion is evidence tampering, every person accused, on trial, or convicted of rape would jump at this.

(17,199 posts)I suppose, by her "logic," if I am the victim of a gunshot wound and have the damage treated, I'm tampering with the evidence and guilty of a felony.
These people make me furious. It is so obvious that they will go to any extent to victimize women, especially women who are raped. Even on it's own "merits" (which really don't exist), this proposition makes no sense. Since when is a fetus evidence of rape? If a woman is raped and doesn't become pregnant, does that mean she wasn't raped? But wait, I thought if a woman was "legitimately" raped, she could "shut down" the pregnancy process, ergo if she is pregnant, she wasn't raped, and if she isn't pregnant, she wasn't raped. Yeah, I guess that really is the GOP message: there is no such thing as rape.

I think you can take comfort in the fact that given that our democratic system is not in ANYWAY designed to be fool proof, such outcomes are always in the realm of possibility.
