Connecticut (Reuters) - A $100 million claim on behalf of a 6-year-old survivor is the first legal action to come out of the Connecticut school shooting that left 26 children and adults dead two weeks ago.
The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.
"As a consequence, the ... child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined," the claim said.

Pinsky's claim said that the state Board of Education, Department of Education and Education Commissioner had failed to take appropriate steps to protect children from "foreseeable harm."

No. How about sucking the Lanza family estate dry and holding the family responsible for raising a monster.

(23,998 posts)...if Adam Lanza was on or withdrawing from an antipsychotic or antidepressant that can cause or exacerbate the symptoms they're supposed to control, maybe the drug company should be held accountable.

(17,863 posts)I was thinking about the liability issue. I wonder how Mrs. Lanza's will reads. Can her son benefit from murdering her (I know you can't in life insurance)? So if not then her full estate probably passes to the older son. She may not have had much of an estate anyway. I don't see how you could go after his father legally.
As far as this lawsuit find the folks least guilty in the incident (the school district) who did have security in place which was bypassed and caring employees who tried their best in an awful situation. Kids are safer at school than at home.

As to any potential lawsuit, this filing of an administrative claim with the state is a prerequisite to bringing a lawsuit against a state/city agency. Once the school district rejects the claim or fails to take action in the time required, a lawsuit can be brought, at which point I am sure more parties than the school district will be sued.

(8,159 posts)Everyone of her classmates was not just shot but blown up ( hollow point bullets). She was laying among them hearing this , seeing their bodies, and knowing that will happen to her. I cannot imagine her terror.
She and anyone would be forever changed. Because of her age I cannot imagine the terror she is living everyday, hell an adult would be emotionally devastated. Look at the first responders.
She is going to need help for a long time.
I hope the lawsuit is against the shooters mothers estate but it probably encompasses everyone involved including the school system.
