Alabama ‘Teabagger’ Brian Downing Sentenced To Two Years For Bourbon Street Prank

The Alabama fan who admitted to placing his privates on a passed-out LSU fan last January learned his sentence this morning. He will get two years in prison.

He’s known to most people as the ‘Bama Teabagger, but his name is Brian Downing and he’s 33 years old.

It was video shot on a cell phone camera that got him into trouble after Alabama beat LSU in the BCS Championship game in the Superdome last January. Downing was videoed in the dining area of Krystal Burger on Bourbon Street exposing his private parts and pressing them against the neck of a passed-out Tigers fan.

The video quickly went viral and Downing quickly found himself indicted on the very serious charge of sexual battery. His attorney cut a plea deal with prosecutors, however, and last month Downing admitted to the two lesser charges of obscenity.

His attorney said the plea deal would give Downing two years in prison, but that he would not have to register as a sex offender.

Wouldn't probation and some community service be more appropriate? Giving what was probably just a drunk moron 2 years in jail seems awfully excessive to me.

He pressed his genitals against another person. Yep, disgusting and stupid. If it were a passed out woman rather than a passed out male it's just as stupid and disgusting but I fail to see how it rises to a higher level of criminal just because the person is female. I don't see any intent on his part to make this about dominating anyone through something as heinous as rape or coerced sexual intercourse. All I see is a dumb drunk asshole doing something stupid.

I fail to see how he sexually assaulted anyone by being a stupid prick.

Also, why would you think pressing his genitals against another male is any less offensive, different or less criminal than if it were a female? Little double-standard there customerserviceguy?

Sex crimes against men are dealt with far less harshly than sex crimes against women, generally, IMHO.

Maybe this sentence will send a strong message to asshats who think they're being cute with their genitals.

You didn't see him trying to do that to a person who was awake. You know why? Becuase the person whom he was trying to do this to if awake would have defended himself and would have kicked his ass.

You might laugh it off if someone did that to you, but most people would not find it funny. Especially with a video of it going viral. I agree that 2 years is a harsh sentence, but it was still a crime that should be punished with at least some time served.

.....as though his feelings about the matter might only exist on the plane of when the event actually occurred. And you are not alone. I haven't found any reference in the written story that speaks to that question either; nor have I found any reference in any of the posts that were made prior to mine that addresses that aspect of the incident.

What in my post made you think that I was not aware of the victims' state of being at the time that the incident took place? Did you think that you were doing me a service by restating the obvious, or were you just trying to talk down to me?

What I was trying to say in a non judgmental and somewhat humorous tone of voice is, "Hey people! Wake up and look at the whole picture. Your captivity within your pathetic dogma of viewing life only on its' surface is clouding your judgement."

For the most part, I have become really disappointed in the one dimensional consciousness with which the people on this board view the events that occur on this planet. Perhaps I am wasting my time here.

I saw it back when the thing first went viral.

The whole thing was despicable, and it definitely was sexual battery.

I'm glad a judge decided this was serious - no one gets to do that to another person.

I'm a huge sports fan, and a college football fan, for sure. People need to fucking correct themselves and stop acting like assholes, at least on that level of advanced asshole.

Maybe this will make people think twice.

Or perhaps even just probation. I agree some jail time is warrented, but 2 years is excessive. I guess he agreed to the long sentence in order to avoid a lifetime sexual offender designation.
