Has anyone said "Recess Appointment" yet?

Of course he cannot appoint Rice until Hillary officailly resigns..

the appointment would only be valid until the next Congress -- which convenes in January.

4. I believe that recess appointments are only good until the end of the current Congressional session

Since this session ends the first week of January they would only be good until then. When the new Congress convenes then each seat filled would have to be re-appointed.
