Shouldn't the SC state what possible cases a sitting president WOULD be immune too? THEN what cases a FORMER president be immune too? THESE 2 questions should have been put to these 6 idiots.

(52,387 posts)but the question is more how much leeway does a president get, what exactly is a "presidential duty" and what isn't, and how does a court decide.
the warren burger court found nixon's tapes didn't fall within the "outer perimeter" of presidential duties and so he had to comply with a subpoena. this is pretty broad immunity but donnie's crimes would surely also fall outside this standard.
the right-wing justices seem inclined to ignore or throw out this standard in favor of something even more broad. certainly that's what donnie is arguing for. the right-wing has long argued that basically anything a president does is part of his duties.
mere mortals understand that campaigning is not part of the job, defaming people is not part of the job, and certainly grifting and raping and worse are not part of the job, but to republicans, yes it is. they even argued that killing political opponents is part of the job,
i guess because putin does it so it's ok for america according to them.
but i expect they will come up with some standard like this.

(17,067 posts)The DOCUMENTS case is the one i really thought could have been brougfht to their attention. THAT case should be allowed to PROCEED, and stop Judge Cannon from her nonsense decisions? What do you think? I thought the arguments could have been lots more personal to these 6 IDIOTS.

again, donnie is arguing that taking classified information is an official presidential act, and that he automatically declassified everything he stole the minute it left the white house, no paperwork required. never mind it's stealing even if it wasn't classified.
but i'm prepared for the supreme court to say it's all up to him.

(17,067 posts)Would allow anyone to take classified documents, and KEEP them, (refuse to return them) after being ordered to return them. That's a stretch to me. Definitely allow that trial to continue, knowing the possibility that foreign countries obtaining them.
