He'll escape being jailed? Especially from Democrats whimping out , and then giving him a deal, and a country club lifestyle for the rest of his life. That would really be upsetting,
I think he'll be restricted to one property, which will be his personal club fed.

(115,869 posts)He could go to prison, though.
The maximum penalty for each of those counts is four years; however New York caps sentencing for this type of felony at 20 years. It is within the judges discretion to decide whether those sentences would run concurrently or consecutively. Because the crimes involve nonviolent offenses and Trump does not have a criminal record, the judge could also consider jailing him for a period that is but a fraction of the maximum penalty.
Another possibility is that the judge could forego prison entirely and place him on probation with the possibility of incarceration looming over his head if he fails to abide by the conditions set by the judge. If the judge should decide to incarcerate post-conviction, Secret Service would become the elephant in the, well, cell. The unprecedented nature of incarcerating a former president would raise questions about how best to ensure equal treatment under the law and security for a former president.

(13,194 posts)dont generally result in prison time.
I just want him convicted of at least one felony charge in this trial. Dont care at all if he goes to prison. At least not for this case.
The Georgia case and the Florida and DC cases are all prison worthy.

(14,838 posts)So he will be free until then either way.
But as a convicted felon, he couldn't vote in FL.
So there is that.
But he would likely get a sentence of 1-3 Years under current guidelines. That could be in a special setting, like a national guard base, or a closed hospital, or some other state facility repurposed for his special needs.
Or he could get home confinement in nys, with special rules.
It's up to da judge. The one he has been threatening.

(3,361 posts)will be have more clarity after the trials begin and witnesses and evidence are brought in front of the jury.
Until then, it's really just guesswork on my part, and my guesses usually have only a 50/50 of being accidently correct.

(21,803 posts)This is not a political prosecution by Democrats. It is a criminal prosecution for cause by career law enforcement.
The reason he will not go to jail is because our Justice System often fails when dealing with the rich and powerful.
I hope some reform-minded Democrats are taking notes of all the deficiencies being exposed in our Justice System with an eye to correcting them.

(115,869 posts)This is not a political prosecution, although Trump wants people to believe that (do you?). Assuming he is convicted (and that's not a sure thing in any criminal case, since the prosecution has the burden of proving the offense beyond a reasonable doubt), his sentence will depend on a lot of things, including the fact that these are Class E felonies, the least serious in NY, sentencing guidelines, the fact that he doesn't have a criminal history (though he should), some level of discretion on the part of the judge, recommendations by the prosecution, and the additional complication of the fact that he also has a Secret Service detail. Your suggestion that he'll be given a deal and a country club lifestyle is on account of "Democrats wimping out" is ignorant and false, not to mention insulting to Judge Merchan.

(11,617 posts)I would feel relief if he is barred from holding ANY office from top to bottom. He can live in exile, but have no more access to resources such as briefings or Secret Service protection. He should also lose all his assets, save one to be exiled in.
His torture would be to see his power and influence whither away along with his status, wealth, and health.
