He referenced the judge and the judge's daughter. Neither are covered by the gag order.

Judge's rarely if ever are covered by gag orders, because the purpose of the gag order is to prevent witnesses, staff etc, lawyers from being influenced/intimidated. It is assumed that judge's will not allow comments from a defendant cloud his or her judgment.

10. For example, Judge Engoron imposed a gag order on trump commenting about court staff.

When Trump was fined for violating it, the judge specifically based his decision on Trump referring to his law clerks, not to the references Trump made about the judge himself.

8. tRump's attack was before the order & it did not mention the judge, who is not "staff"

That is my recollection of the timing.

Judges are never "staff". They are in charge. Courts have staff and the Judge is the embodiment of the Court. Lawyers address the Judge with "May it please the Court, could we ....". (As an aside, dogs have pals but cats have staff.)

It is common for Judges to not include themselves in such gag orders, probably because of a tradition of not making rulings that personally favour themselves. In the NY fraud case, Engoron issued a gag order and did not include himself. These are my observations as a non-lawyer.
