I mean, if the constitution isn't a hindrance to an insurrectionist earning his party's nomination, why shouldn't an Obama run against him?
If the 14th Amendment doesn't matter, then we can ignore the 22nd Amendment, the one that stops Barack Obama from running.
if the 14th Amendment doesn't matter, then we can ignore Article 2, Section 1, Clause 5 that prevents 25-year-old Malia Obama from running.

(15,507 posts)I blame Republicans pissed at FDR for winning 4 terms, although I must admit, he had no business running for the fourth term in his health. Perhaps if he hadn't, there'd be no 22nd.

In 1918, Victor Berger ran for Congress while under indictment for espionage. He wasn't kicked off the ballot.
He won the election. In January, he was found guilty of espionage. Congress kicked him out.
They held a special election, he ran in the special election. They didn't kick him off the ballot.
He won the special election. He was unseated by Congress again. He wasn't prevented from running.
