"WE PETITION THE OBAMA ADMINISTRATION TO:Enforce Section 3 of the 14h Amendment
Section 3 of the 14th Amendment states: No person shall hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof...
States have no Constitutional authority to secede from the United States. Threats of secession constitute a rebellion against the Constitution.
We petition that all elected officials who have signed petitions demanding secession, or who have otherwise engaged in rebellion against the Constitution by, for example, calling for the arrest of federal agents operating under Constitutional authority, be identified and removed from office."

Note that not only does this address the issue of secession, but also the situations like we have in Wisconsin in which some legislators have proposed arresting federal agents who enact federally-mandated health care provisions.

we have a voting process to remove people from office.

Insurrection and rebellion are specific terms and cannot be legally used in the fashion that this petition lays out. Sedition might be a possibility.

I remember a Junior High civics class where the teacher asked if anyone ever had the right to advocate the overthrow of the government. Of course, everyone said no, so he pointed out that is exactly what the out-of-power party is doing in every Presidential election. The only prohibition is to advocate that overthrow by violence or subversion.

(4,522 posts)Isn't this like renouncing citizenship? Doesn't that have a lot of implications for voting, buying a gun etc? Might want to mention that to some of the nutbags out there
