A tale of two criminals (a matter of justice)

Criminal number one aided and abetted a kidnapper who made sure a mother will never see her child again. He acted with malice of forethought and out of bigotry. He will get at most 3 years.

Criminal number two grew pot for their own medical use. He got 10 years.

Now which criminal is worse? One aided and abetted a crime that is horrible beyond belief. A woman will never see her child again. Never see her date, never comb her hair, never teacher her to drive, never see her graduate from college, never walk her down an aisle. The other criminal, wanted to ease his pain and harmed no one. He stole no one's money, beat no one up, kidnapped no one's child. There is literally no one anywhere who is worse off due to this man's crime. Yet the first criminal will get at most 1/3 as much time as the second.
