Family sues Upstate college over son's choking death

SPARTANBURG, S.C. (WCSC)
A Lowcountry family is suing an Upstate college after their son died from choking on pizza. A wrongful death lawsuit was filed late last week in Spartanburg County.
Randall Heffron Jr. died a year ago this month at Wofford College. The Spartanburg County Coroner's Office says 20-year-old Heffron died as a result of choking. Coroner officials say Heffron had an elevated ethanol level that may have contributed to vomiting which led to extensive aspiration of food.
The suit says the campus security officers acted with gross negligence and recklessness and had negligent training and supervision.
The coroner says Heffron had a blood alcohol level more than three times the legal limit.

You always hear about cases like this, but you never hear of the outcome.

(111,367 posts)This kid was blotto, though, and they'd do much better if they sued whoever poured that much booze into him.
As it is, even if they can find a sympathetic jury, this will be overturned on appeal.
You never hear of the outcomes because the outcomes are never newsworthy.

(46,215 posts)Generally, campus security has a minimal duty to protect students' safety and their lives with basic training such as CPR and Heimlich Maneuvers. To let this case go to a jury would more or less mandate that security would have been a state certified EMS worker. Not to mention the plaintiff self-induced his intoxication; there's quite a bit of culpability to be considered.
