The Legislature will not even be in session again until January 2021.

that it depends on:

1. The republican party in each state following the law
2. The republicans in the house and senate following the law

This whole plan basically recognizes that the electors sent by the legislature in each state would not be legal.
The plan isn't based on that, the plan is based on:

1. The legislatures sending their own slate
2. (Assuming republican control of both houses is maintained), each house voting to accept the electors submitted by the legislatures not the state
3. The Supreme Court saying "we'll allow it."

Now, there are multiple ways to moot this:

1. Win by such a margin that this becomes wholly untenable (e.g. Win Florida, or Georgia or NC, or even Texas)
2. Win a few more state delegations in the House.
3. Win the Senate
4. Rely on republicans at some level/in enough states to follow the law and rules
5. Rely on the Supreme Court to reject these moves

Now, I don't have to tell you, I have a lot more confidence in doing 1-3 than I do 4-5.
