Federal judge issues restraining order against Trump's federal agents in Portland

Tonight's restraining order is nothing short of a win for the rule of law.

BREAKING: A federal court just issued a restraining order on the federal agents in Portland, Oregon.

We said we would deploy the full firepower of the ACLU in this fight to save our democracy — and we meant it.

A federal judge on Thursday issued a 14-day order, temporarily barring federal officers from using force, threats and dispersal orders against journalists or legal observers documenting the daily demonstrations in downtown Portland.

During the hearing, U.S. District Judge Michael H. Simon quoted case law from the 9th U.S. Circuit Court of Appeals, saying, “When wrongdoing is underway, officials have great incentive to blindfold the eyes of the Fourth Estate. The free press is the guardian of the public interest, and the judiciary is the guardian of the press.”

My sense is that's exactly what he plans to do.

Portland Police Bureau and the Trump administration have responded to nightly protests in Portland over the police killing of George Floyd by indiscriminately using tear gas, rubber bullets, and acoustic weapons against protesters, journalists, and legal observers, even after the federal court enjoined such violent attacks in a lawsuit filed by the ACLU of Oregon. Federal officers also shot a protester in the head Sunday with a rubber bullet fracturing the person’s face and skull.

The ACLU has filed multiple lawsuits across the country in response to unconstitutional law enforcement attacks on journalists and protesters, including suing President Trump and other administration officials for the firing of tear gas on protesters outside the White House on June 1.
