Armed US agents on city streets: can President do that?

... Trump says federal agents could be deployed elsewhere as he makes law and order a central element in his struggling re-election campaign ...

... Federal authorities can enforce federal laws on federal property, like the courthouse in downtown Portland. But state and local officials say the federal agents have operated beyond their jurisdiction, and that has raised constitutional issues now being challenged in court. As Michael Dorf, a professional of constitutional law at Cornell University, told The Associated Press, “The idea that there’s a threat to a federal courthouse and the federal authorities are going to swoop in and do whatever they want to do without any cooperation and coordination with state and local authorities is extraordinary outside the context of a civil war" ...

... Employing DHS on its own, in a mission that seems to be suspiciously aligned with the president's reelection campaign, appears to be unprecedented. “If the public begins to perceive that they are being partisan in how they operate they lose credibility, and if they lose credibility, they lose public trust,” said Cohen, who now teaches at Georgetown University ...

Sen. Tammy Duckworth (D-Ill.) on Tuesday excoriated President Trump’s threats to send the federal officers dispatched to Portland, Ore., to Chicago, calling the ultimatum “disgusting.”

“My answer to him is don’t even think about it,” Duckworth, a combat veteran who lost both legs in Iraq, said on CNN Tuesday. “This is disgusting, and it is the further politicization of our institutions, which should be nonpartisan. He did it with the military when he sent National Guard troops against peaceful protesters in Lafayette Square <in Washington, D.C.>, and now he’s done it in Portland and he’s coming to Chicago. Don’t even think about it” ...

Mayors in major cities like Chicago and Detroit are pushing back against efforts by President Donald Trump administration to deploy federal agents .. to more cities ...

... Trump also said he's looking to send troops to Detroit, the Detroit Free Press reported. In an emailed joint statement, Mayor Mike Duggan and Police Chief James Craig said they haven't had any communication with the federal government about this plan ...

"There could be no possible justification for such an action. The Detroit Police Department has had the support of the Detroit community in making sure our city did not have a single store looted or a single fire started during the protests," the statement said. "Unlike nearly every other major city in the country, the Detroit Police Department never requested assistance from the National Guard — we handled our issues as a community. We definitely have no need for any federal presence being sent in now."

In New York City, Mayor Bill de Blasio said he wouldn't allow Trump to send in any troops. In a tweet, de Blasio wrote: "We've seen the chaos secret police are creating in Portland. We won't let it happen here" ...

... Trump has also intervened in other cities, including Washington ... The show of force came to a head when federal authorities in riot gear dispersed crowds from Lafayette Square across from the White House, where the president then posed with a Bible in front of a church ...

... former Homeland Security officials say they’ve seen nothing like the Portland deployment, which has included using highly trained Border Patrol agents to confront protesters outside the downtown courthouse, without the cooperation or consent of local law enforcement or government officials.

“Urban policing and crowd control and civil unrest isn’t something that is in their wheelhouse,” said Gil Kerlikowske, a former commissioner of U.S. Customs and Border Protection under President Barack Obama. “It’s not something they are trained for. It’s not something they have any experience or expertise in” ...

... Trump made a point of saying the mayors of the cities on his list were liberal Democrats, underpinning concerns the threat was politically motivated ...

De Blasio said Trump's threat was likely bluster, but added that he would challenge any deployment in the courts. He said the actions of unidentified officers grabbing citizens in Portland "appeared to violate basic constitutional rights."

"This president blusters and bluffs and says he's going to do things and they never materialize on a regular basis, so we should not overrate his statements, they are so often not true" ...

legal experts said there were limits to Trump's power and that he could be challenged in court. "The president is not the king," said Kent Greenfield, a Boston College law professor ...

It was the FOP head in Portland who coordinated with Trump and asked the Feds in. I think I read that the FOB head in either Detroit or Chicago had been in touch with Trump. At this stage, the police union is causing more violence and refusing to help calm the situation. This union needs to be disbanded, but that may be impossible if only members can vote to do so. The union is far too powerful.

The Posse Comitatus Act. ... “Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.”

The United States Coast Guard (under the Department of Homeland Security) and United States Space Force (under the Department of the Air Force) are not covered by the Act either, primarily because although both are armed services, they also have maritime and space law enforcement missions respectively.

The Insurrection Act, Chapter 13 of Title 10 (10 USC Sections 251-255). This act allows the President to use U.S. military personnel at the request of a state legislature or governor to suppress insurrections. It also allows the president to use federal troops to enforce federal laws when rebellion against the authority of the U.S. makes it impracticable to enforce the laws of the U.S. by the ordinary course of judicial proceedings.

The federal government is waging war on citizens who are legally protesting using their 1st Amendment rights in violation of the United States Constitution and against the wishes of local authorities and American citizens. We are now a giant step into fascism. We need to take a stand NOW or it will be too late. I am worried and !
