SAN JOSE – The Oak Grove School District has confirmed one of its employees is a “person of interest” in a case involving a woman who intentionally coughed on a baby at a San Jose Yogurtland last week.

In a statement, the district said it was “aware of an incident allegedly involving one of our employees who was videotaped coughing on a baby.”

“We do not tolerate conduct from any employee that compromises any child’s safety,” the district said. “The employee who has been identified as a person of interest in this matter is currently off of work and not providing any services to our District students.”

The employee was not named in the statement. The district said it is cooperating with a police investigation.

San Jose police Sgt. Enrique Garcia said detectives are following up on leads and have not made an arrest.

The incident was reported at the Yogurtland at 5638 Cottle Road about 5:25 p.m. on June 19.

A woman, who was standing in front of a mother and her 1-year-old child, was upset that the mother was not “maintaining proper social distancing,” and removed her face mask, got close to the baby’s face and coughed two to three times, Garcia said.
