Without seeing anything more, this apparently was the 3 judge panel's opinion. There was always speculation that the ruling would hinge on 1 judge (and I apologize her name isn't popping into my mind) but you can be assured that this will be elevated to the full panel now.

Judge Sullivan will not take this ruling sitting down,

but at least this decision needs to be affirmed by the full Court of Appeals, at a minimum.

We are deeply indebted to him for that. The report that he requested that retired Judge to enter into the record is now public information. The fraud has at least been well documented. He did what he could and what he could do still matters.
