(82,849 posts)Pete Williams was reporting on the Today Show. His analysis is that the Court ruled that the administration hadn't followed the procedure for ending the DACA program. Trump's argument was that because then-AG Sessions told him that DACA was an illegal program, he had no choice but to terminate it. The Court majority didn't buy it, because there is a procedure laid out on the law and the administration didn't follow that procedure. The Court did not say whether DACA was legal or illegal (it wasn't a question the Court was asked), but that the administration had arbitrarily and capriciously tried to end the program.
What's alarming to me is that four justices were just fine with the Attorney General simply making a declaration that a government program was illegal and that was enough to terminate it, no matter what the consequences are to the people depending on the program.
