(13,424 posts)3. It is not being used in Utah. It is being used by the DC mayor to kick out the UT National Guard.
The Third Amendment prevents the quartering of soldiers during peacetime. The DC mayor does not want an occupying force of soldiers in her city so she is invoking the Constitution to send them packing.

Because they cannot be quartered in DC hotels, which are covered under third amendment.
