(7,432 posts)Watching the slow spin downward isn't good for viewing. But Schiff MUST hear the plea to file the motion, and he MUST do it. Filing for a mistrial is based in reality, legal precedent, and common sense. Not doing so would be an Al Gore moment.

There is no evidence of a trial.
There's no branch of coequal government that can hold the other accountable, except Congress over the Executive. Which has been attempted and fallen short of the "removal" outcome.
There's no governing body that can do a thing to these senators, unless they've committed theft, fraud or malfeasance, in which case only the courts in their licensing jurisdictions can really do anything to them.
Any attempt to do this would be laughed out of town and used as a campaign issue as proof of the Democrats' foolishness.

(129,096 posts)they started it at 11 ET today (vs at 1 pm ET). After all of this, if they continue today, they will go into a period of what the Senate calls "Morning Business" (without Roberts needing to be there), where Senators can then talk about whatever subject they want (including the impeachment) but in this case, only up to 10 minutes each. And that will go on until Wednesday afternoon, when they will conclude that "deliberation" portion of the trial, and do the final vote.
