Watching the slow spin downward isn't good for viewing. But Schiff MUST hear the plea to file the motion, and he MUST do it. Filing for a mistrial is based in reality, legal precedent, and common sense. Not doing so would be an Al Gore moment.

There is no evidence of a trial.

There's no branch of coequal government that can hold the other accountable, except Congress over the Executive. Which has been attempted and fallen short of the "removal" outcome.

There's no governing body that can do a thing to these senators, unless they've committed theft, fraud or malfeasance, in which case only the courts in their licensing jurisdictions can really do anything to them.

Any attempt to do this would be laughed out of town and used as a campaign issue as proof of the Democrats' foolishness.

It is fortunate that there is a Senate of the United States; a body not yet moved from its propriety, not lost to a just sense of its own dignity and its own high responsibilities, and a body to which the country looks, with confidence, for wise, moderate, patriotic, and healing counsels. It is not to be denied that we live in the midst of strong agitations, and are surrounded by very considerable dangers to our institutions and our government. The imprisoned winds are let loose. The East, the North, and the stormy South combine to throw the whole sea into commotion, to toss its billows to the skies, and disclose its profoundest depths. I do not affect to regard myself, Mr. President, as holding, or as fit to hold, the helm in this combat with the political elements; but I have a duty to perform, and I mean to perform it with fidelity, not without a sense of existing dangers, but not without hope.

Slide 1:

The subjects of its jurisdiction are those offenses which proceed from the misconduct of public men, or, in other words, from the abuse or violation of some public trust. They are of a nature which may with peculiar propriety be denominated POLITICAL, as they relate chiefly to injuries done immediately to the society itself.

...

Slide2:

The prosecution of them, for this reason, will seldom fail to agitate the passions of the whole community, and to divide it into parties more or less friendly or inimical to the accused. In many cases it will connect itself with the pre-existing factions, and will enlist all their animosities, partialities, influence, and interest on one side or on the other; and in such cases there will always be the greatest danger that the decision will be regulated more by the comparative strength of parties, than by the real demonstrations of innocence or guilt.

Mon Feb 3, 2020, 12:44 PM
Feb 2020

they started it at 11 ET today (vs at 1 pm ET). After all of this, if they continue today, they will go into a period of what the Senate calls "Morning Business" (without Roberts needing to be there), where Senators can then talk about whatever subject they want (including the impeachment) but in this case, only up to 10 minutes each. And that will go on until Wednesday afternoon, when they will conclude that "deliberation" portion of the trial, and do the final vote.

B. THE INAPPROPRIATENESS OF SEEKING JUDICIAL ENFORCEMENT OF THE COMMITTEE SUBPOENAS

The Committee concluded that it would be inappropriate to seek the aid of the courts to enforce its subpoenas against the President. This conclusion is based on the constitutional provision vesting power of impeachment solely in the House of Representatives and the express denial by the Framers of the Constitution of any role for the courts in the impeachment process.

The reasoning behind this is political, of course.

But I gotta say this: ANY Senator--Democrat, Republican, whatever--who is basing their vote on whether it will help/hurt their reelection chances should probably just resign, then. You would think voters would appreciate a principled rep than just a political one. But...eh...this stopped being a nation of principled people long ago, I guess...
