Can Roberts declare a mistrial and force a do-over?

Let's ignore all that hubub about witnesses for a minute.



The US Senate has set rules by which this trial is to be conducted.

1. One of those rules is that the Senators are supposed to stay in their seats. The GOP violated this rule multiple times and left for lengthy times. One Republican even left in the middle of the trial to give an interview on Fox News.

2. The Senators were supposed to hand questions to Roberts, so he could read them to the impeachment managers and to the defense-lawyers. Instead, the defense-lawyers were caught on camera writing questions for the GOP Senators.

3. The defense-lawyers made factually wrong statements. And AFAIK lawyers are under obligation to tell the truth in court, even though they are not under oath. AFAIK a lawyer lying in court is subject to disciplinary actions of the court-system (fines, imprisonment, temporary or permanent loss of licence). E.g. just a few days ago there was a lawyer who lied during discovery to hide evidence and he was sentenced to a $10,000 fine. A few months ago another lawyer lied in a court-document and only came clean after the judge threatened him with jail.



With all the DEFINITELY NOT REGULAR shit going on during the trial, the trial is definitely already tainted, witnesses or not.

The CJ is only the presiding officer under the rules of the Senate. He doesn't have the same powers as a trial judge.

NO WONDER THEY WANTED NO MORE ADDITIONAL WITNESSES !
