If one cannot win on the procedure to get the issues before the trier of fact -- judge or jury -- one never can get up to bat to hit the home run win on the merits.

as soon as I saw procedures start to change or established procedures (think Roberts Rules of Order) begin to be applied strategically, I knew a coup of some kind was coming. I have never been proved wrong.
