he chooses not to flout the Constitution (yes, Trump is his boss for all practical purposes).

of course he can. He'll do anything he wants to and no one, it seems can do anything about it.
Apparently, the Senate Majority leader is literally the most powerful person in government.
He can do whatever he wants to and there are no consequences, he has ultimate veto power over all legislation and over all appointments.
Well, when it's a Republican anyway.
