The way I see it, checks and balances gives our government legitimacy

So if there exists an executive branch that can force it's agenda on the legislative and judicial branch and can just suddenly deny and checking and balancing the other two branches can do on it; then, as far as we should be concerned, that executive branch is NOT the political body as described in the Constitution.
