BREAKING: A judge has ruled a jury can consider the Castle Doctrine - basically a Stand Your Ground law - during deliberations to determine whether a Texas woman should be punished for entering the wrong apartment and fatally shooting an unarmed Black man.

(17,865 posts)and still the Texas Rangers tried to smear his reputation. She got to purge her texts from that night (some were recovered). How many other suspects who just shot someone in their own home get to stay on their phone and even go home that night with their phone. Most of the time it would go into property while she is booked, and the police would be getting a search warrant to check out its contents.

Ridiculous? Yeah, but so is the idea that she walked in, killed a man in his own house, and may get off without any truly serious consequences.
After abbreviated testimony on Saturday, defense attorneys rested their case first thing Monday morning. During a session, outside of the presence of the jury, defense attorneys and prosecutors argued over the language of the instructions the judge with provide to jurors. It was during this session that Judge Tammy Kemp ruled the jury can consider the Castle Doctrine during deliberations.
The Castle Doctrine, similar to the Stand Your Ground Law, allows a person to use or using force (even deadly force) in the protection of a home, vehicle, or other property if someone attempts to forcibly enter or remove an individual from the premises.

It was disgusting from the start as the Texas Rangers who should have been adversaries in investigating her, were actually cheer leading for her.

(6,831 posts)How in the BLUE FUCK could she have been in a position to invoke the Castle Doctrine when she was the ONLY one armed ??? NO WAY should she be allowed to use this as a defense.
If she walks, there simply is NO JUSTICE anymore for people of color in this country.
