Was he a Nevada resident? You're supposed to show Nevada ID to purchase a gun.

"A person may only buy a firearm within his own State except that he may buy a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides.

He appears to have legally bought the rifle in Nevada. He may have violated CA laws in taking it back into CA.

(11,738 posts)California has some of the toughest laws on firearms but I don't think that he violated any of the laws here either. The person on Twitter said it was an SKS rifle. If the rifle was unmodified it is compliant with current California laws regarding auto loading rifles. Currently California Law states that you cannot possess an assault weapon which is defined as:
1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
(A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
(B) A thumbhole stock.
(C) A folding or telescoping stock.
(D) A grenade launcher or flare launcher.
(E) A flash suppressor.
(F) A forward pistol grip.
(2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
(3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches [762 mm].
The SKS is a centerfire rifle that has a traditional wooden rifle stock, a fixed magazine that holds a maximum of 10 rounds that is loaded by stripper clips through the action at the top of the rifle and it is a longer rifle so unless the shooter modified it by shortening it, or putting on any of the above mentioned accessories, it was legal to possess in California. I have seen them sold at Big 5.

(7,412 posts)I believe most are CA legal if they have a fixed magazine of 10 rounds or less, a fixed stock and no muzzle device (like a flash hider or grenade launcher adapter).
The fixed magazine versions can be quickly reloaded with stripper clips, just about as fast as a detachable magazine can be switched.

If the background check exceeds three (3) days, the seller may sell the person the gun without having to wait any longer.

(34,661 posts)Was the purchase made in Reno or Sparks? Would be interesting as to the source of the purchase. Understand the Dealers here in Vegas are nervous in selling this Guns even to anyone.
