Alabama Woman Indicted After Someone Else Shoots Her in the Stomach, Killing Her Unborn Child

An Alabama woman who was shot in the stomach, resulting in the death of her unborn child, was indicted on a manslaughter charge by a grand jury. The reason? She started the dispute that led to her getting shot.

Initially, police charged 23-year-old Ebony Jemison for shooting 27-year-old Marshae Jones in December of 2018 outside a Dollar General in Birmingham. But according to AL.com, a police investigation determined that it wasn’t Jemison who was to blame for the shooting—it was Jones, for starting it:

“The investigation showed that the only true victim in this was the unborn baby,’’ Pleasant Grove police Lt. Danny Reid said at the time of the shooting. “It was the mother of the child who initiated and continued the fight which resulted in the death of her own unborn baby.”

Reid added that the fight began over the unborn baby’s father, and that the investigation found that Jamison was defending herself.

Effectively if you are pregnant in Alabama wrap yourself in cotton wool, or live in fear...cause you never know. It is outrageous!

A bevy of questions related to self defense, that could be an OP on it's own, the root question is: is a fetus a separate entity and does it have rights?

If the answer to that is no, then the fact that she was pregnant/ the fetus was terminated is irrelevant.
If the answer is yes then the question becomes who is responsible, which goes back to the self defense questions

for being involved with a man who had a gun, and would get mad enough to shoot her?

HIGH POINT, N.C. — Police in High Point are investigating a deadly shooting involving a pregnant woman.

Police identified the victim as 21-year-old Tontoria York of High Point. She was 9 months pregnant. Police say her baby did not survive.

During their investigation officers say they determined the shooting was domestic related and charged 20-year-old Hayes with First Degree Murder.

Isn't the child's father criminally liable? After all, there wouldn't have been a confrontation if he wasn't (presumably) two-timing, right??

And since when did "The person who starts the altercation is legally at fault" become a thing?? Years ago countless DUers were more than happy to smugly explain why that couldn't be used against George Fucking Zimmerman...
