The new bill would make it so anything up to one ounce of marijuana can only be punished with a fine of up to $50, down from $100, regardless of a person’s record. One to two ounces can only be punished with a fine of up to $200 — eliminating potential jail time — regardless of record. It would also get rid of a loophole in the previous marijuana decriminalization law for cannabis in “public view.”

"New York had decriminalized possession of up to 25 grams (nearly an ounce) of marijuana in 1977 to only punish it with a fine. But that law imposed criminal penalties with potential jail time for those with a previous record. And it included a loophole: If marijuana was in public view (say, if a police officer got someone to empty his pockets), then it could still be treated as a crime punishable with potential jail time — a loophole that the new bill closes."

The marijuana bill will make possession of up to two ounces a violation, punishable by small fines, rather than a crime. Further, it will expunge arrest records for possession of small amounts of marijuana and curb police enforcement that supporters say disproportionately targeted young black and Latino men.

“Decriminalizing marijuana, paired with expunging records for these low-level offenses, will help undo some of these decades long injustices, and allow for people to be productive and successful," Assembly Speaker Carl Heastie (D-Bronx) said Friday morning.

"This is not the final step, but it will lay the groundwork for full decriminalization and legalization in the future,” Heastie added, referring to the broader effort on marijuana.

is that police will have discretion about writing up violation tickets, just like they do with traffic laws. It means that if you know a cop, you'll be sent on your way, but if that cop wants to screw with you, they can get fifty bucks out of your pocket.

It's bull.
