New Mexico Gov. Michelle Lujan Grisham on Friday lashed out at members of a militia group who are stopping migrants at the border, declaring "regular citizens have no authority to arrest or detain anyone."
The American Civil Liberties Union of New Mexico has demanded that Lujan Grisham and New Mexico Attorney General Hector Balderas investigate the militia organization, United Constitutional Patriots. Some of the group's members are armed.
"That migrant families might be menaced or threatened in any way, shape or form when they arrive at our border often times after an unimaginably arduous journey is completely unacceptable," Grisham said in an email to NBC News.
"It should go without saying that regular citizens have no authority to arrest or detain anyone," she said. "My office and our state police are coordinating with the Attorney General's Office and local police to determine what has gone on and what can be done."
Balderas warned in a statement that "these individuals should not attempt to exercise authority reserved for law enforcement," he said.
The ACLU of New Mexico raised the alarm about the arrests in a letter sent Thursday to Grisham and Balderas.

(100,080 posts)Rather than attempting to play police, why don't they do us a favor and join the army? They can take their aggressions out there.
We don't need these types in the US Army. They'll only bring their problems and issues into an honorable profession.

(14,961 posts)me. I am beyond proud of him. I honestly didn't want him to enlist after Trump became president. Even though he is excelling and loves it, I worry much more than I would have under a stable president.

(11,949 posts)She should send the state police or even national guard to prevent an armed, organized effort to illegal restrain people.
And when they try to pull a Bundy ranch deal and aim their firearms at law enforcement, do what normally happens. Shoot the motherfuckers.

(22,133 posts)detain these persons, and if anything, should be sued for damages by unlawfully detaining these individuals (instead of detaining these people, they should call the authorities if they are truly concerned about illegal activity, but not themselves engage in illegal activity too (unlawfully detaining someone against their will, failure to report a crime to authorities, etc.)).
Someone is going to inadvertently get hurt by these RAMBO nuts.

(13,920 posts)But yes. I'd love to see a wave of civil suits. Lets see them patrol the border once their guns, vehicles and fancy cammo garb belong to the assorted immigrants and citizens that they have harassed.

During the past four years, the Minuteman groups that defined conservative immigration policy during the mid-to-late-2000s have mostly self-destructedsometimes spectacularly so. Founding Minuteman leaders are in prison, facing criminal charges, dead, or sidelined. It really attracted a lot of people that had some pretty extreme issues, says Juanita Molina, executive director of the Border Action Network, an advocacy group that provides aid to migrants in the desert. We saw the movement implode on itself mostly because of that. An analysis by the Southern Poverty Law Center, which monitors right-wing extremist groups, found that the number of Minuteman groups in the Southwest had declined from 310 to 38 between 2010 and 2012.

(2,256 posts)If the Governor is going to claim that regular citizens have no authority to arrest anyone, then she may want to have the law changed to reflect that.
New Mexico 31-4-14
The arrest of a person may be lawfully made also by any peace officer or a private person without a warrant upon reasonable information that the accused stands charged in the courts of a state with a crime punishable by death or imprisonment for a term exceeding one year, but when so arrested the accused must be taken before a judge or magistrate with all practicable speed and complaint must be made against him under oath setting forth the ground for the arrest as in the preceding section [ 31-4-13 NMSA 1978]; and thereafter his answer shall be heard as if he had been arrested on a warrant.

Yeah, I didnt think so. Your cited statue has zero applicability.

(2,256 posts)Words matter. For the Governor to say that a regular person has no right to arrest someone is false under her States own law. Thats all Im pointing out. Im not happy or do I excuse what some psycho with a gun is doing to people crossing the border.

(4,723 posts)I have some great memories from my teen years of visiting the great state of New Mexico with my grandpa. I am glad they now have a governor like this.
My great hope is that, some day, historians will see this dark era for what it is. People like governor Lujan Grisham deserve to be remembered for standing up against tyranny.
