It was Mueller's job to decide. And he didn't.

From an email that TPM received from a reader:

“We’ve credited him (Mueller) with far more moral rectitude than he has actively shown. ..........
It is inexplicable that he deferred the question to “the politicals” especially in light of Barr’s well-known opposition to any obstruction charge. Imagine a judge in a criminal or civil matter saying “fuck if I know” “.
Josh Marshall has a different take on this but I agree with the email writer.

We know that Barr claims Mueller didn't make any adjudication. We have no reason to believe that.
