On obstruction, Barr says Mueller laid out evidence rather than coming to a conclusion on the "difficult" question, leaving it to DOJ to determine if there was a crime. Barr says that he and Rosenstein believe there is insufficient evidence to establish that there was a crimeLink to tweet

Not really, they had already decided months ago.

(14,732 posts)10. Remember that Rosenstein cheerfully wrote the bullshit letter Trump asked
him for "justifying firing Comey", and was never taken to task over it. He has been a Trump flunky from day one, and there's no mystery why he is still hanging on in DOJ. He had to be there until he and Barr wrote the whitewash letter. As for Barr, leaving aside his interference in the Iran-Contra scandal we have the evidence that he considered Mueller's entire investigation to be illigetimate and unneeded. The two of them are Trumpettes from day one.

for my money, the most dramatic news is the second paragraph on page 3 -- Barr and Rosenstein took it upon themselves to make and disclose a prosecution decision re the President's potential obstruction of justice (despite the OLC memo saying Trump can't be prosecuted in office).
This is a complicated and problematic decision for both of them. Before he took office, Barr wrote a memo preemptively attacking the obstruction component of Mueller's investigation. Rosenstein was part of the conduct (firing Comey) that the investigation would have examined.

Both the Attorney General and Deputy Attorney General, in other words, had highly compelling reasons to recuse themselves from making any decision about whether Trump obstructed justice. They made the decision anyway, and in a manner that appears to serve their own interests.

Per a DOJ official: #Mueller was not consulted in the creation of this letter to Congress, nor was he at the department today. It was the product of Barr, Rosenstein and advisors including from the office of legal counsel.

obstruction of justice case. I was wondering how they would resolve that. I just assumed he would end up testifying against rump....silly me!
