That wearing a red tie is an impeachable act, then it is so. Impeachment is completely up to the discretion of the House of Representatives.

But nobody seems to talk about that.

If you read the actual filing, it refers to another victim who was killed. The original California filing had a lot more depraved stuff in it, but it was toned down for the New York version.

How one is going to premise an impeachment proceeding on a complete absence of witnesses or a victim, however, would be a puzzle.
