The Courts would have said that it was constitutionally ok to bypass Congress. Precedent would have been set and if a future Court refuses to acknowledge that, the Democratic President could announce that the Supreme Court is non functional, and declare a national emergency allowing that President to ignore it's rulings.

We need to stop this being the better party shit. If republicans don't help us stop Trump on this, then it is time to go down into the sewer after them, with knives in our mouths. They would have opened a pandoras' box.

20. Maybe worse than a distraction. What powers does POTUS claim during a national emergency? Because

no one buys the border is a national emergency claim, not even the gop. Not a good enough reason. So what is the real reason behind this? Just a vanity wall? Really? Or will there be special protections for the president? Special powers of the purse? A halt to investigations? Marshall Law? Short cutting legislation?

The first instinct of congress, media, pundits etc should be the default assumption that he's lying, has ulterior motives, is out to enrich himself, is out to help himself, trying to 'get over' on someone, or is just trying to hurt others. Or all of the above. That's the start of the conversation.

All this for a distraction? Maybe. Or maybe not.

A national emergency allows him to reprogram military construction funds. The law's intent was obviously to repel invasions and such, but the language is vague for him to argue that he could do whatever he wants with the money.

Politically, his base will be happy he did everything he could to build the wall, even if he loses in court.
