Cohen's intimidation claims may leave Trump exposed to another felony: MSNBC analyst

MSNBC national security reporter Ken Dilanian said Wednesday that Michael Cohen’s claim that President Donald Trump has threatened his family could leave the president exposed to another felony charge: witness tampering.

“Witness intimidation is something that the president has been accused of, and what he has been doing with Michael Cohen online,” said host Katy Tur, asking Dilanian if the president’s frequent attacks on his former fixer added up to a crime.

“Many legal experts have said on our network and other places that this could add up to witness tampering and witness intimidation,” replied Dilanian.

“[Convicted Trump presidential campaign manager Paul] Manafort was charged with witness tampering for seemingly less than this, for simply articulating a false story to a witness,” he continued. “Perhaps this will a subject of the long awaited report by special counsel Robert Mueller, whether this fits into the pattern of obstruction of justice that Mueller appears to be investigating.”

Witness tampering is the act of attempting to alter or prevent the testimony of witnesses within criminal or civil proceedings. Laws regarding witness

tampering also apply to proceedings before the U.S. Congress, executive departments, and administrative agencies. To be charged with witness tampering in

the United States, the attempt to alter or prevent testimony is sufficient. There is no requirement that the intended obstruction of justice be completed.
