The evidence is clear that Secretary Rosss rationale was pretextual...the court can not sustain agency action founded on a pretextual or sham justification that conceals the true basis for the decision.

If the question had remained on the census, the rightwingers would have collected the data and misused it. We don't need to give them any more data to misuse, they already have enough.
