(42,727 posts)I don't think he can cite the Fifth Amendment as the basis for refusing to appear when subpoenaed -- if he wants to invoke the Fifth he has to do it question by question. So, in theory, the Committee could insist on his complying with a subpoena to appear and give testimony and charge him with contempt if refuses to appear.
Whether he can use the Fifth Amendment as a shield against producing documents is a more complicated question. Sometimes the answer is yes, sometimes the answer is no.
And he could be offered immunity from prosecution by the committee and then forced to testify (again with contempt as the hammer).
