From what I've seen however, Democrats will top out at 38-39.

(42,704 posts)The Republican leads that race by 400+ votes, but there are still some provisional votes (and a smaller number of write in votes) to be tabulated. The Democrat could still take it. While McMurray has not yet conceded to incumbent Repub Collins in NY 27, it seems unlikely that result (which is already being counted in the R column) will change.
The number of seats picked up varies depending on how one measures (and from when). Some sites say that it is currently 38 and could go to 39. Others say its currently 39 and could go to 40. If you measure from the number of seats won by the republicans in 2016 (241), I think we're looking at a max pick up of 40. If you take into account Conor Lamb's earlier special election win, the number of seats gained on election day would max out at 39.
