(10,130 posts)Judge affirms order evicting Michael Avenattis law practice from office in Newport Beach
http://www.latimes.com/politics/la-na-pol-avenatti-eviction-20181116-story.html
In a brief hearing at Orange County Superior Court in Santa Ana, Judge Robert J. Moss affirmed his Oct. 22nd order that Avenatti and his staff vacate their ocean-view suite in a building across from the Fashion Island mall. He ordered them to leave by Monday.
Avenattis longtime law firm, Eagan Avenatti, skipped $213,254 in rent payments due over four months, leading the landlord, the Irvine Co., to sue for eviction.

Judge enters $4.85 million judgment against Michael Avenatti

I posted yesterday about his assault which I was not able to conclude either way

I do not know how much of the above is true and accurate. But police charges and judgments are not media errors. Innocent until proven guilty but those entities have rules on how they're supposed to operate which I give more weight to than a TMZ report.
I loved how he went after Trump but as a potential leader for 2020 (which I have never taken that seriously because of his lack of experience in government), this is way too much messy baggage.

The judgment in question was settled and is really an harassment suit brought by miffed partner...
The so called assault still has not produced a victim..

(10,130 posts)Seven figures owing as a politician? Everyone? I don't think that will play well during an election.
"The judgment in question was settled and is really an harassment suit brought by miffed partner..."
I don't think that is accurate:
Stormy Daniels' lawyer Michael Avenatti ordered to pay $4.85 million in dispute with former colleague
Michael Avenatti, Stormy Daniels' lawyer, must pay $4.85 million in a lawsuit over back pay, a judge said.
The judge said Avenatti must pay the money because he personally guaranteed a settlement with a former colleague.

The RNC has filed two information requests on Avenatti's arrest - one for the video.

Grassley's going after him for the Kavanaugh witness thing.
He's going to get the Hillary Clinton bashing treatment times ten. Like Hillary, even if he's innocent, they're going to mess him up.

(12,422 posts)You owe the IRS the minute you pay off last years taxes...
The suit in question is still in dispute because ex partner thought he was owed more monies...
The RNC is going after Comey and Hillary again..
Grassley is a dinosaur walking...and has opened up a can of whoopass on he and Brett boy..
Yeppers cant wait for that can of whoopass to open up..

(10,130 posts)Part of his effectiveness is that he seems to be well supported by the facts.
I hope this stuff doesn't destroy him. We need more like him going after the GOP.
Some of his tax problems went back some years. He reportedly claims to have paid off liens from 2015 taxes last summer though the reporter could not verify payment had been made and the liens were still there.
When a judge orders Avenatti to pay up on his personal guarantee, this: "still in dispute because ex partner thought he was owed more monies." doesn't hold as much water for me because a judge has rendered a decision in the dispute on the money owing.
He looks like someone with serious financial problems struggling to stay ahead of his creditors. That will lead to the obvious political criticism: "if he can't keep his own house in financial order, how can he be expected to manage the country's finances?"
I cannot take his leadership aspirations very seriously. Some of Trump's problem is his lack of experience in government. Obviously, Avenatti or nearly anyone out of grade school has more on the ball than Trump but I'm not up for someone with no experience in government in a very senior position. Experience matters.

(12,422 posts)THAT IS Still being litigated...
If owing money to anybody was serious concern to voters...OMG...
This is all manufactured bullshit...

(10,130 posts)LAPD criminal charges ? Maybe. Or maybe not. The jury is out on that. It's a felony charge so they're not screwing around with a little misdemeanor.
2015 Tax liens he claims to pay off? Nope, that is not "manufactured bullshit". He was delinquent paying his taxes so they slapped a tax lien on him. The jury is only out on whether he really paid off those liens.
Corporate bankruptcy of a firm he owned 75% that the court agreed left his partner owed $10 million? Nope, that is not "manufactured bullshit" That is a court looking at it and rendering it's conclusion. I think he alleges a counter claim but I haven't seen that.
A judge ordering him to pay $4.85 million to his partner based upon a personal guarantee he provided? Nope, that is not "manufactured bullshit" That is a court looking at it and rendering it's decision - in spite of him saying he might have a counter claim nobody has seen.
A judge ordering his law firm evicted from their offices for non-payment of four months of overdue rent (over $200,000)? Nope, that is not "manufactured bullshit" That is a court looking at it and rendering it's decision. He tried to stop it and failed.
Avenatti successfully defended Stormy based upon the facts. All I'm doing above is providing a similar yardstick of looking at the facts to his circumstances. My concerns or conclusions are not based upon "manufactured bullshit" - they're based on the rule of law and the facts. Hopefully, he can pull rabbits out of his hat and make this all go away but it doesn't look good for him right now

(658 posts)and not paying what you owe to the IRS are two entirely different things.
Keep it real, man.

(62,444 posts)Yes, the case with the former partner had been settled. The problem was that Avenatti didnt pay the settlement, forcing the former partner to get another judgment.
And sure, the landlord was disgruntled because the landlord had not been paid. You dont get evicted because your landlord is disgruntled.

(12,422 posts)And expected more....WRONG

(62,444 posts)Particularly given that it is in defense of a lawyer whose recent media reputation consists of bringing lawsuits and not winning them.
Yes, frivolous lawsuits are filed. And the usual outcome of frivolous lawsuits is that they are thrown out and/or the person who brought it is sanctioned. The usual outcome is not a win for the plaintiff.
So, what you are saying is that Avenatti has a poor record of defeating frivolous lawsuits against him, since he keeps getting judgments against himself in them. Is that really what you are trying to say? The guy cant defend a single frivolous suit against himself?

(12,422 posts)In other words, the landlord wants more money he thinks he is owed, and Avenatti says NO...

At a Friday hearing at Orange County Superior Court, Judge Robert J. Moss reportedly affirmed his October decision to evict law firm Eagan Avenatti after it failed to pay $213,254 in rent over four months. Moss reportedly ordered the law firm out of its ocean-view suite by Monday. Avenatti also claimed Avenatti & Associates, which reportedly shared staff and office space with Eagan Avenatti, had an oral rental agreement with the landlord. The landlord reportedly denied any such agreement
In an email, Avenatti told the Times the decision did not matter as his former firm was already in the process of moving. A non-event.
This is also entertaining in view of the that was my former firm thing with the bankruptcy. His former firm which had the same staff in the same office.

(658 posts)Been living in CA for more than two decades. Neither landlords nor tenants have it easy, but the court doesn't just side with a "greedy" landlord. The courts award landlords what they are legally due.
It seems somebody on here just can't face reality about Avenatti.

My understanding is that the LAPD confirmed hed been arrested. Has the LAPD released any other details? I cant see why they would.
