Why isn't openly defying the constitution grounds for impeachment?

Trump took an oath: "I do solemnly swear that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."

He is violating the oath of office. Why does he get away with it?

We don't currently have the votes to impeach him, and all of the Republicans are on his side.

And even after the election, we won't have sufficient votes in the Senate to remove him from office. (Even if we massively outperform current polling.)

It's just basic math.
