Kavanuagh lied to Congress but they didn't make the FBI talk to him because

a GOP Congress will not hold him accountable for lying under oath, the FBI would hold him accountable if he lied to them in the course of an investigation.
They had to rig it this way to win.

this is the first sign the FBI starting to get worn down on holding honor and decency. Now doing some work for the GOP.
