He said on FOX News that you had to go back to the 1890's to find where a Supreme Court Justice was confirmed in an election year.

I don't know if that is true or not, but the numbers alone show him to be full of shit.

It's not like a Supreme Court Justice is dying every year? And if they do die, what are the odds they will die in a presidential election year? How many opportunities has there been to appoint a Justice in an Presidential election year?

Common sense would tell us that this would be a very rare event.

After Oliver Wendell Holmes retired on Jan. 12, 1932, Benjamin Cardozo was nominated by President Herbert Hoover on Feb. 15, 1932, and confirmed by the Senate nine days later. (Hoover lost his reelection bid that year.)
