If his election was nullified then would Clinton be declared the president? I hope that someone with the knowledge about congressional law could provide insight.

(8,200 posts)This is an area that has never been explored. Nullification of the election making every act Trump did be completely declared to not be rolled back. This would include the latest Supreme Court appointment. I would like to have a constitutional lawyer provide an opinion.

(11,744 posts)It would be good, but there is no precedent or structure in place that could be used to make those changes. I am certainly not a constitutional lawyer, but I would imagine that this is a question that has been asked of them.

(8,200 posts)That oath includes every law and statute which includes those laws governing the manner of election. If it is found that they gained office by fraud then what is the determination as to their oath being a sham? These are the questions that have not been answered because this situation has not been previous confronted. I have two friends who are attorneys who just responded to me. Both said they are not constitutional lawyers and believer that it would have to go before the Supreme Court as to the election being subject to nullification. They responded that there have been cases of nullification but thought these pertained to fraudulent vote counts and where people were denied right to vote.
Here is what I am getting at. If Trump is impeached and removed from office Pence becomes president. If the election could be nullified then Pence would not be automatically made president since they run as a single entity and every act Trump did would be wiped off the books.

About our only hope is for a lot of Democrat victories in the midterms. Then impeachment and conviction might become possible.

If trump is accused directly of criminal or treasonable crimes and goes to jail, impeachment won't matter. Hell no longer be president if he goes to jail.
Admittedly it could take some time but under arrest there's no way he can be allowed to govern and even the Republican quislings would have to acknowledge that.

How does that stand with the absolute thinking of the founders who wrote extensively in the Federal Papers that a democracy is founded on the principle that no one is above the law. This is the bed rock principle upon which the so-called divinely justified authority of kings was above question and which was absolutely denounced as heresy by the founders of our republic. Under the law that we live under, each and every person is accountable for their actions even to the extent that ignorance is not even excusable. It is founded upon the concept that people of sound mind are endowed with the concept of right and wrong. What we are witnessing is a person in power who is assuming powers that the constitution never provided.
The claim that a president can not be indicted is nonsense in view of the principle that no one in above the law. Who in the hell convinently provide this exception. The constitution provides for the secussion of power in case the president in incapacitated. I find the argument that the president is indisposal for the operation of government to be a fallacious argument to circumnatigate the duty that each and every citizens is to be held accountable regardless of their claims of indispensibilty. It sounds like something that Dumposwitz dreamed up during his nape.

Cohen is looking at a long time in prison if Trump somehow manages to stick everything on him (like The White House Attorney guessed could happen to him. Now it is a case of a first rat eating the other rat before the second rat turns to eat the first. The only thing that is certain is that a rat will get eaten, Cohen seems to be trying to make sure it isn't him.

He might tick up the evangelical numbers a little, but hes not enough of an open dick to excite trumps 30% gutter dwellers. Those people would fade away at the polls.
I genuinely believe a good number of republican politicians loathe trump, and see that he is damaging their party. But they cant cross him because hell give them a stupid nickname and tweet about them. And theyll lose an election.
As much as I hate Pence, he will never be as bad as trump across the board. Lesser of the evils kind of thing, I guess. I hate such scenarios.

But I think hes significantly less electable than trump. He has no where near the charisma (Im not even sure thats the right word) trump seems to have with that base.
I think of it this way. If Kasich or Rubio had squeaked out 2016, and then ran the country the way trump has with the scandals and convictions - how many republican politicians would still be in their corner? Many, sure, but not anything like the cover trump enjoys. Part fear of turning off the base, part self incrimination, part fear of changing demographics - whatever it is, the Republican Party is terrified of crossing him or being against him in public. I dont think any other person gets that protection. Not even Pence.
But dont get me wrong. Pence is shit. I just think hes a slightly smaller pile.

(11,107 posts)There is nothing that says there is not a sealed cooperation agreement. Neither is there anything that says Cohen will not cooperate for sentencing consideration - just for consideration by the judge at sentencing.
Cohen's lawyer made it clear that the bird may (or may not) be singing but he sure as hell is warming-up.

The value of cooperation for sentencing purposes is less than it was before today. The value of cooperation is lower yet after a conviction next week.

But the closing question was devoted to whether Cohen "knows things" about Trump and would tell the truth. Davis said he had long conversations with Cohen about Trump's suitability to be president, and that Cohen was motivated to tell the truth for the best interests of the country and also for Cohen's family.
So it sounded like the same thing, even if not specified.
Earlier, Davis said that Trump's legal team in writing to special counsel emphasized that Trump "directed" Cohen to make the hush money payment. Davis really made a point of that, as if to indicate the Trump lawyers screwed up without realizing it, and Davis was delighted about it.

(5,316 posts)...clarify the situation, it is my understanding that if one is pardoned, they may still be subpoenaed in an investigation and would not be allowed to plead the 5th Amendment right against self-incrimination, since they accepted the pardon and therefore they are not subject to prosecution for their statements/testimony.
In other words, they'd be forced to talk or face charges of contempt of court.

Is it correct that considering this plea deal, Cohen's testimony will now only be through interviews before the Grand Jury?
Regardless of the delays, I agree with you that this is a huge step toward vacating this monster from our White House.....
