The incident was confirmed by the town attorney Robert Subik, who told the Daily Gazette in Schenectady that the license was rejected because they didn't make an appointment and because of Eriksen's religious beliefs ...
The couple went to neighboring Cobleskill and got the license.
While a deputy clerk can grant a marriage license, the state's 2011 "Marriage Equality Act" doesn't allow a clerk to reject a license based on religious beliefs ...

Which is it? What does not making an appointment have to do with anything? Would Eriksen have not allowed an appointment to be made in the first place?
So you get there, and they say, sorry....no appointment. Obviously you then make one. I guess except when you have a bigoted clerk, that may soon be looking for a new job.
