The Roberts Court is on track to overtake the Taney Court

They're upholding the travel ban.

Any bets on whether, ultimately, they'll concede that the due process guaranteed by the Constitution doesn't apply to non-citizens?

My bet is, they'll go for it.

And make the Taney Court look like amateurs in the vileness annals.

I have always wondered whether Justices Taney, Nelson, Grier, Wayne, Daniel, Campbell, and Catron ever understood the opprobrium they brought upon the Court and upon themselves as perverters of justice. And if they ever had any regrets.

Haven't found any historical references that speak to that, yet.

But in any case, I'm fairly sure that Roberts, Thomas, Alito, Gorsuch and Kennedy are blissfully anticipating the plaudits of history.

And I think they will end up in the same dustbin with the Taney justices.
