1. i read it a little differently.

my read is kennedy is saying:

"even though it's obvious that this ban violates the establishment clause and free exercise of religion by discriminating against islam, we're going to give it the supreme court stamp of approval."

"then we're going to hope that, contrary to everything everyone knows about donnie, he's going to provide us political cover by making it clear that islam is actually welcome in america after all and that this travel ban has nothing to do with islam."

"that way we can pretend that it isn't anti-islam, even though it's so obviously anti-islam that i felt it necessary to write a separate opinion so i could beg for political cover."
