EL PASO, Texas (AP) — The Latest on the separation of immigrant children from their parents (all times local):

12:55 p.m.

The head of U.S. Customs and Border Protection says he has temporarily stopped referring for criminal prosecution adults who cross the border illegally with children.

Commissioner Kevin McAleenan told reporters in Texas Monday he ordered referrals suspended within hours of President Trump’s executive order last week that stopped the practice of separating families.

He says that the zero tolerance policy remains in effect, but cases cannot be prosecuted because parents cannot be separated from their children.

He says he is working to develop plan to resume illegally entry prosecutions of adults with children.

Meanwhile, Attorney General Jeff Sessions said in Reno, Nevada that federal prosecutors would continue to criminally prosecute adults caught crossing the border.

But Border Patrol agents must refer cases for prosecution.

More than 2,300 children were separated from their families before the order last week that is causing chaos at the border on how to implement it.

There was a concern a couple years ago that since there was rush to hire agents, there was still a 2 - 5 year backlog on security clearances in the Department of Homeland Security, and they had been finding that since the mid-2000's, there was a move by all sorts of gang members (including MS-13 gang members along with other groups like Hell's Angels, Rainbow, et all, who are involved with smuggling trafficking...) and White Supremacists to apply for ICE and Border Patrol. Supposedly, that was part of the background of that "Fast and Furious" debacle - and Border Patrol agents still are quietly being moved around once gang affiliation is discovered in their background.

It's assumed that a good 5% of Border Patrol and ICE couldn't pass a security clearance for employment. But once they're employed and past the probationary period, their Supervisors and Union protects them, even if they're suspected of using their gang connections for "additional income" along the border. Finding out the occasional Border Patrol agent was "looking the other way" when a criminal came over or drugs or weapons were being brought across has been a major bone of contention with the local Sheriff's department. Especially since the Border Patrol protects their own in those situations.

On Edit - DHS is perfectly willing to hire police academy and military wash-outs or those with admin separations if they exhibit the "right attitude" to be out in the field. The smart people or the ones who are willing to do a good job they tend to put in offices or in urban locations where they can interact pretty much only with "decent folks".
But they love to put the bullies and other knuckleheads out in the desert or on the swoop teams. It doesn't matter what race those people are, DHS doesn't want too many thinkers out there, they want mindless muscle.
