SCOTUS Punts On Partisan Gerrymandering But Allows WI's GOP Map To Stay

The Supreme Court rejected a challenge brought against the Republican-drawn legislative map in Wisconsin, in an unanimous decision that said the challengers who had sued over the map did not have standing.

Monday’s decision appeared to punt on the substantive issues in the case: whether an extreme partisan gerrymander can amount to a constitutional violation. The high court is sending the case back down to the lower court to allow the challengers to Wisconsin’s map to narrow their lawsuit.

“We express no view on the merits of the plaintiffs’ case,” Chief Justice John Roberts wrote the majority’s opinion.

Justice Elena Kagan wrote a concurring opinion, where she was joined by Justices Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor. Justice Clarence Thomas also wrote a concurring opinion where he was joined in part by Justice Neil Gorsuch.

Roberts, in his opinion, wrote that the voters could only challenge the drawing of the specific districts in which they vote, and not the entirety of a state’s map, as had been done in the Wisconsin case before the court, Gill v. Whitford.

Not only do we have to do everything in our power to get the American People out to vote in Nov to take back the House and the Senate - we have to focus our attention to the Governorships and State Legislatures and take those back from the Repugs as well. Then we have to use the tools that they implanted in the states - that of gerrymandering - against them.

Maybe they'll get the message when they are gerrymandered from power and they'll make the appeal to SCOTUS and maybe then SCOTUS will do something to make elections fair again.

I've said it here many times before - we need to make the Midterm Election Historic. We need to GOTV to the extent that the Nov 2018 election sets a record for Americans voting. It has to be the most people that ever came out to vote than any other election in the history of this country.

The Repugs are going to pull out all the stops to suppress votes, gerrymander, steal and cheat - all with the help of the Russian interference - because nothing was done to prevent what happened in 2016 to happen again in 2018. The only way we'll be able to counteract the Repugs and Russian tampering is if we turn out Dem voters in record numbers.

Again - I've posted this many times here on DU and am astonished that I never get any support of this idea from other DU'ers. Am I wrong with urging for a historic election? If I am - please tell me what I'm missing here.

The Dems should have started making this appeal to the American People months ago. I know we're still approximately 5 months from the election. However, if we don't start now - we'll never break through the Repugs attempt to spin the voters in their direction with their media megaphone.

We have plenty of fodder for political ads in the run-up to the election - with all the mayhem that the Repugs and Trump have caused since he took office. We need to start the ball rolling now to GOTV even if we have to use the Repug game plan of appealing to one issue voters out there.

Please. please make the Nov 2018 Midterms an Historic Election.

Take over the fucking state legislatures via the ballot box and change the damned laws to something that is both fair and constitutional.
